EDPB Cookies Report As Cookies Guidelines or Not
Even EDPB refrain from defining the findings in its recently published Cookies report as recommendations, these could be determined as a general guidance
European Data Protection Board (EDPB) has published a report of the work undertaken by the Cookie Banner Taskforce. The positions presented in this document result from the coordination of the members of the Taskforce (TF) with a view to handling the “cookies banner” complaints received from NOYB. According to the document, after 13 meetings of the TF members (national SAs) numerous points were noted.
Even if this document is a report, it should be apprehended as guidelines that show how to implement cookies properly in websites and what can be considered as wrong or dark pattern. There are several practices that are mentioned in the report and examined as follows:
- “NO REJECT BUTTON ON THE FIRST LAYER“
- “PRE-TICKED BOXES“
- “DECEPTIVE BUTTON COLOUR“
- “DECEPTIVE BUTTON CONTRAST“
- “LEGITIMATE INTEREST CLAIMED, LIST OF PURPOSES“
- “INACCURATELY CLASSIFIED ESSENTIAL COOKIES“
- “NO WITHDRAW ICON“
